Terms of Service

Welcome to MyFirstWebsite. These Terms of Service ("Terms") cover your use of the MyFirstWebsite website, editor and hosting service (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. Your account

You must be at least 13 years old to create an account. You're responsible for keeping your password safe and for everything that happens under your account. Please tell us right away if you think someone else is using your account.

2. Your content

You own the text, photos and other material you put on your website ("Your Content"). By publishing Your Content with the Service, you give MyFirstWebsite permission to store, copy and display it as needed to run the Service. This permission ends when you delete Your Content or your account, except for copies kept in our regular backups for up to 30 days.

You're responsible for Your Content. You promise that you have the right to publish it and that it follows our Community Guidelines.

3. Comments and guestbook entries

Visitors may leave comments and guestbook entries on member websites. On sites using the Free plan, comments and guestbook entries are reviewed by MyFirstWebsite before they're published, and we may decline to publish any comment for any reason. On Pro and Business sites, the site owner reviews comments. People who leave comments are responsible for what they write.

4. Things you may not do

  • Publish content that is illegal, threatening, harassing or hateful, or that shares someone's private information without their permission.
  • Pretend to be another person or organization.
  • Publish material that infringes someone else's copyright or trademark.
  • Send spam, host viruses, or use the Service to attack other computers.
  • Use the Service mainly to store files that aren't part of your website.

5. Removing content

We may remove content or suspend a website that breaks these Terms or our Community Guidelines. We'll usually let you know by email, unless the law or the safety of others makes that inappropriate.

6. Paid plans

Pro and Business plans are billed in advance, monthly or yearly. You can cancel at any time; your plan stays active until the end of the period you've paid for. We offer a full refund if you cancel within 30 days of your first payment. Domain name registrations are non-refundable.

7. Service availability

We work hard to keep the Service running, but we can't promise it will always be available or error-free. From time to time we may need to take parts of the Service offline for maintenance.

8. Disclaimer and limitation of liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT ALLOWED BY LAW, MYFIRSTWEBSITE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.

9. Changes to these Terms

We may update these Terms from time to time. If we make important changes, we'll post a notice on our home page and in the editor. Continuing to use the Service after a change means you accept the new Terms.

10. Governing law

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of law rules.
